Privacy Policy

General information

This privacy statement is intended to inform the users of this website about the nature, scope and purpose of the collection and use of personal data by the website operator CHB Chanson Barmettler GmbH. This is not an exhaustive description; if necessary, other data protection declarations or general terms and conditions, conditions of participation and similar documents regulate specific matters.

This data protection regulation is aligned with the EU General Data Protection Regulation (GDPR). Although the GDPR is a European Union (EU) regulation, it is relevant to us. The Swiss Data Protection Act (DPA) is heavily influenced by EU law, and companies outside the European Uniton or the European Economic Area (EEA) must comply with the DPA in certain circumstances.

Artistsman AMZ GmbH is responsible for the data processing described here. If you have any data protection concerns, you can inform us of them via e-mail to chanson@artistsman.com or by post to the address in the imprint.

Purpose of processing personal data and legal basis

As a matter of principle, we process personal data of our users only insofar as this is necessary for the provision of a functional website as well as our contents and services.

In addition, we process personal data of you and other persons, insofar as permitted and it appears to us to be appropriate, also for the following purposes, in which we (and sometimes also third parties) have a legitimate interest corresponding to the purpose:

-Offering and further developing our offers, services and websites, apps and other platforms on which we are present;

-Communicating with third parties and processing their enquiries (e.g. applications, media enquiries);

-Examination and optimisation of procedures for needs analysis for the purpose of direct customer contact as well as collection of personal data from publicly accessible sources for the purpose of customer acquisition;

-Advertising and marketing (including the organisation of events), insofar as you have not objected to the use of your data (if we send you advertising as an existing customer, you can object to this at any time and we will then put you on a blocking list against further advertising mailings);

-Market and opinion research, media monitoring;

-Assertion of legal claims and defence in connection with legal disputes and official proceedings;

-Prevention and investigation of criminal offences and other misconduct (e.g. conducting internal investigations, data analysis to combat fraud);

-Guarantees of our operations, in particular IT, our websites, apps and other platforms;

Video surveillance to maintain house rules and other measures for IT, building and facility security and protection of our employees and other persons and assets belonging to or entrusted to us (such as access controls, visitor lists, network and mail scanners, telephone records);

-Purchase and sale of business units, companies or parts of companies and other transactions under company law and the associated transfer of personal data as well as measures for business management and insofar as for compliance with legal and regulatory obligations as well as internal regulations of XXX.

If you have given us consent to process your personal data for certain purposes (for example, when you register to receive newsletters or carry out a background check), we process your personal data within the scope of and based on this consent, unless we have another legal basis and we require such a basis. Consent given can be revoked at any time, but this has no effect on data processing that has already taken place.

Cookies/Tracking and other technologies related to the use of our website

Hostin provider & server log files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

-IP address

-browser type and browser version

-Operating system used

-referrer URL

-Host name of the accessing computer

-Time of the server request

-Amount of data sent in bytes

This data cannot be directly assigned to specific persons. This data is not merged with other data sources. We reserve the right to check this data retrospectively if we become aware of concrete indications of illegal use. The data is stored for security reasons, e.g. to be able to clarify cases of abuse. If data must be retained for evidentiary reasons, it is exempt from deletion until the incident has been definitively clarified.

This data as well as all data on this website is stored by our hosting provider Hostpoint AG, Neue Jonastrasse 60, CH-8640 Rapperswil-Jona, whose privacy policy can be found here. We have concluded an order data processing contract with Hostpoint AG.

Cookies

Like many other websites, we also use so-called "cookies". Cookies are small text files that are transferred from a website server to your hard drive. This automatically provides us with certain data such as IP address, browser used, operating system and your connection to the Internet. Cookies serve to make our offer more user-friendly, effective and secure. Cookies cannot be used to launch programs or transfer viruses to a computer. We can use the information contained in cookies to make navigation easier for you and to enable the correct display of our web pages. Under no circumstances will the data we collect be passed on to third parties or linked to personal data without your consent. Of course, you can also view our website without cookies. Internet browsers are regularly set to accept cookies. In general, you can deactivate the use of cookies at any time via your browser settings. Please use the help functions of your internet browser to find out how to change these settings. Please note that individual functions of our website may not work if you have deactivated the use of cookies.

Registration and comments on posts

On this website, we offer users the opportunity to register by providing personal data. The data is entered into an input mask and transmitted to us and stored. You can then log in to our website and use certain functions such as the comment function.

When visitors post comments on the website, we collect the data displayed in the comment form, as well as the visitor's IP address and the user agent string (this identifies the browser) to help detect spam. Visitor comments may be examined by an automated spam detection service.

An anonymised string may be created from your email address (also called a hash) and passed to the Gravatar service to check if you are using it. The privacy policy of the Gravatar service can be found here. After your comment has been approved, your profile picture will be publicly visible in the context of your comment.

If you are a registered user and upload photos to this website, you should avoid uploading photos with an EXIF GPS location. Visitors to this website may download photos stored on this website and extract their location information.

Embedded content from other websites

Posts on this website may contain embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves exactly as if the visitor had visited the other website.

These websites may collect information about you, use cookies, embed additional third party tracking services and record your interaction with this embedded content, including your interaction with the embedded content if you have an account and are logged into this website. For information on data processing, please refer to the relevant websites.

Analytics services

This website uses functions of the web analysis service Google Analytics. The provider is Google Inc, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. Google LLC complies with European data protection law and is certified under the Privacy Shield agreement.

Google Analytics uses so-called "cookies". These are text files that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there.

We have activated the IP anonymisation function on this website. This means that your IP address will be shortened by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area before being transmitted to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

You can prevent the collection of the data generated by the cookie and related to your use of the website (incl. your IP address) by Google as well as the processing of this data by Google by downloading and installing the browser plugin available under the following link: https://tools.google.com/dlpage/gaoptout?hl=de.

Social media

We also use so-called plug-ins from social networks such as Facebook, YouTube, Google+, Pinterest, Instagram, Xing or LinkedIn on our website. This is apparent to you in each case (typically via corresponding icons. We have configured these elements so that they are deactivated by default. If you activate them (by clicking on them), the operators of the respective social networks can register that you are on our website and where and can use this information for their purposes. The processing of your personal data is then the responsibility of this operator according to its data protection regulations. We do not receive any information from them about you.

Google Fonts

For a consistent display of fonts, this site uses web fonts from Google. When you open a page, your browser loads the required web fonts into your browser cache in order to display texts and fonts correctly.

To do this, your browser must establish a direct connection to the Google servers. Google thereby becomes aware that our website has been accessed via your IP address. Google web fonts are used in the interest of a uniform and appealing presentation of our plug-in. If your browser does not support web fonts, a standard font from your computer will be used.

For more information on the handling of user data, please see the FAQ and Google's privacy policy.

YouTube

Our website uses plugins from YouTube, which is operated by Google. The operator of the pages is YouTube LLC, 901 Cherry Ave, San Bruno, CA 94066, USA.

YouTube is used to make our website appealing. When you visit one of our pages with a YouTube plugin, a connection to the YouTube servers is established. Here, the YouTube server is informed about which of our pages you have visited. If you are logged into your YouTube account, your browsing behaviour can be directly linked to your personal profile. You can prevent this by logging out of your YouTube account.

For more information on the handling of user data, please refer to YouTube's privacy policy.

Data transfer and data transmission abroad

As a rule, we do not transfer your personal data to third parties for purposes other than those mentioned above. We only pass on your data to third parties if:

-you have given your express consent to this,

-the processing is necessary for the execution of a contract with you,

-the processing is necessary for the fulfilment of a legal obligation,

-processing is necessary to protect legitimate interests and there is no reason to assume that you have an overriding legitimate interest in not having your data disclosed,

other reasons mentioned in this privacy policy.

Duration of retention of personal data

We process and store your personal data as long as it is necessary for the fulfilment of our contractual and legal obligations or otherwise for the purposes pursued with the processing, i.e. for example for the duration of the entire business relationship (from the initiation, processing to the termination of a contract) as well as beyond that in accordance with the legal storage and documentation obligations. In this context, it is possible that personal data will be retained for the time during which claims can be asserted against our company and insofar as we are otherwise legally obliged to do so or justified business interests require this (e.g. for evidence and documentation purposes). As soon as your personal data is no longer required for the above-mentioned purposes, it will be deleted or made anonymous as far as possible. For operational data (e.g. system protocols, logs), shorter retention periods of twelve months or less generally apply.

Data security

We take appropriate technical and organisational security precautions to protect your personal data from unauthorised access and misuse. To protect the security of your data during transmission, we use state-of-the-art encryption procedures (e.g. SSL) via HTTPS.

Obligation to provide personal data

Within the scope of our business relationship, you must provide the personal data that is required for the establishment and implementation of a business relationship and the fulfilment of the associated contractual obligations (as a rule, you do not have a legal obligation to provide us with data). Without this data, we will generally not be able to enter into or perform a contract with you (or the entity or person you represent). Also, the website cannot be used if certain information to secure traffic (such as IP address) is not disclosed.

Profiling and automated decision-making

For the establishment and implementation of the business relationship and also otherwise, we generally do not use any fully automated decision-making (as regulated, for example, in Art. 22 DSGVO). Should we use such procedures in individual cases, we will inform you separately about this, insofar as this is required by law, and inform you about the associated rights.

Rights of the data subjects

Within the framework of the data protection law applicable to you and insofar as provided therein (such as in the case of the GDPR), you have the right to information, correction, deletion, the right to restrict data processing and otherwise to object to our data processing, as well as to the surrender of certain personal data for the purpose of transfer to another body. Please note, however, that we reserve the right to enforce the restrictions provided for by law, for example if we are obliged to retain or process certain data, if we have an overriding interest in doing so (insofar as we are entitled to rely on this) or if we need the data to assert claims. If you incur costs, we will inform you in advance. We have already informed you about the possibility of revoking your consent in section 3. Please note that exercising these rights may conflict with contractual agreements and may have consequences such as premature termination of the contract or costs. We will inform you in advance if this is not already contractually agreed.

The exercise of such rights requires that you clearly prove your identity (e.g. by means of a copy of your identity card). To exercise your rights, you can contact us at the address given in section 1.

For users who register on our website, we additionally store the personal information they provide in their user profiles. All users can view, change or delete their personal information at any time (the user name cannot be changed). Administrators of the website can also view and change this information. If you have an account on this website or have posted comments or contacted us via contact forms, you may request an export of your personal information from us, including any information you have provided to us. In addition, you can request the deletion of any personal data we hold about you. This does not include data that we are required to retain for administrative, legal or security purposes.

In addition, every data subject has the right to enforce his or her claims in court or to lodge a complaint with the competent data protection authority. The competent data protection authority in Switzerland is the Federal Data Protection and Information Commissioner.

Changes

We may amend this privacy policy at any time without prior notice. The current version published on our website shall apply. If the data protection declaration is part of an agreement with you, we will inform you of the change by e-mail or other suitable means in the event of an update.
